  • BaLiZer’s website (The Aforementioned: The Website) is an Internet site that operates an online flower shop, offers its customers information and sells different products (floral bouquets, plants, decorative pieces etc.) (The Aforementioned: The Services). This site is under the ownership of the company BaLiZer Flower Delivery Ltd. R.N. 513439562 (The Aforementioned: The Company)

  • All the rules and regulations appearing here apply equally to both genders. In some cases the masculine pronoun may be used, simply for ease of reading.

  • All the customers of this service, future customers and/or those requesting information through this site, and/or those who are surfing into this site, and participating in the activities offered through this site, declare that they have read the regulations and agree to its conditions.

 

Conditions for use of the site - purchasing and information services

  • Several different actions can be done on this site - to place an order and to obtain service and/or information. Do not use this site for other purposes.

  • Every person above the age of 18 and who has a valid credit card which is accepted in Israel (or who has permission from the credit card's owner) (The Aforementioned: The Buyer) is allowed to place an order through this site.

  • An order or an offer to place an order (The Aforementioned: The Offer) of a purchase, in order to receive services, will be granted only if all of these conditions are fulfilled: (1) We can confirm this transaction was authorized through the credit card company of the buyer;

(2) The products requested are available in the inventory;

(3) The shipping address where the service will be delivered, is within the company’s service zones;

(4) The buyer owns a valid and authentic email address (unless the order is placed by phone through the Sales Center).

 

How to place an order through this site

  • In order to get a full description of the procedures on how to order through our website, please look under - How to Buy in Appendix A. All the information in How to Buy is included in the disclaimer, and on the condition that it is read, qualifies one to place an order with the company.

 

The policy of services and pricing

  • Reservations on this site will be processed only if an order exceeds the value of NIS 50 (excluding shipping and handling fees).

  • Pictures of flower bouquets, bunches, arrangements, and plants (The Aforementioned: The Products) are displayed for the sole purpose of products' illustrations. It is declared by the Company and agreed by the Buyer that the actual delivered Products may not look identical to their pictures.

  • All of the services, prices (including shipping and handling fees) and the conditions of payment made available through this site can change occasionally, and will be done so on the exclusive judgement of the company.

  • In the event where an order to purchase a floral bouquet or a flower arrangement presented on our site is made, and the item is out of stock, the company will deliver to the buyer, a product which is as similar as possible to the original product ordered – similar in colour and/or in the type of product that was purchased through the original transaction.

  • In the case where an alternative item presented on the website is out of stock, a message will be sent to the purchaser through email or by phone. The company reserves the right to offer an alternative product with a similar character and price. If the buyer approves, the details of the reservation will be updated. If not, the reservation will be deleted and the credit card will not be charged.

  • Local delivery will reach the requested destination according to: (1) the delivery time interval as specified in the various Delivery Service Level options (as specified in the "Delivery Date" and "Delivery Time Preference". The Aforementioned: DSL), which is selected by the Buyer during the order placement procedure; (2) the time of the Offer placement; (3) the deadline for placement of a DSL as specified in the selected DSL. Delivery of "Same Day order" is done in the afternoon/evening unless a special DSL is requested. Offers which are placed when the Sales Center is closed or after the placement's deadline of the selected DSL, shall be treated as if they are placed on the opening time of the Sales Center on the next working day. Balizer is a florist in Israel and our services are for domestic shipments only.

  • The Sales Center's working hours are: Sunday through Thursday 9:00 AM to 2:00 PM; Fridays and the morning before a holiday from 9:00 AM till 12:00 PM. All hours are according to Israel time (GMT+2).

 

Buyer details and Internet website security

  • At the time the order is placed through the website, the buyer will be expected to supply private details, details of the order, credit card details and so forth into the system (The Aforementioned: The Details). The owner of this site, and/or site operator, and/or site management, and/or those commissioned on their behalf, are not responsible for any mistake that has been made by the buyer while adding these details. Furthermore, the aforementioned will not be responsible directly or indirectly to assume responsibility for the situation where the details of purchase are not received by the system, and/or for any technical problem, and/or for any other problem that may prevent operation of this site.

  • Adding false details is a criminal felony. Those who submit false details will be taken to court, and this could include suing for damages from damages caused to the site, and/or to site owners, and/or to site operators, and/or site management, and/or those commissioned on their behalf. In the case that details are submitted incorrectly (including personal details of the buyer), the company reserves the right, and/or those commissioned on the company’s behalf, to cancel the order.

  • The database processor of this company manages details of every action that is conducted at this site. These details will serve as proof to all transactions made. However, the server clock will be used to decide the exact time as to final and conclusive evidence as to when the order was placed on the site.

  • All the transaction details from the site, including the details of the order, and the details of the purchaser, will be transferred through Secure Sockets Layer (SSL) - widely-used in electronic trade - into the data-processing computer of the company. These details will not be shared by the company, or its operators, to any third party sources, not including the credit card company and the suppliers expected to fill the order placed by the purchaser. The company reserves the right to use the details that the buyer will supply, in order to statistically analyze the data and to provide this information to other sources. In this case, the data will not refer personally to the buyer and will not be associated with him.

  • The company reserves the right to send the buyer electronic mail and reach him in writing or verbally with all the information regarding promotions held by the company, new items on the website, and promotions on other commercial enterprises, unless the buyer will announce in writing that he is not interested in receiving such information.

 

Payment for the services

  • All the prices that are presented on this site include taxes, unless mentioned differently. The payment will be charged to a credit card of which details are added during the order, or close to the time that the merchandise is dispatched to the address mentioned in the order. If there is a policy of the company to allow special payment plans of these goods, it will be done so accordingly (under the approval of the credit card company).

  • The purchase total that the Buyer will be charged will be seen in “Checkout” page. This sum will include all the details that are appearing in the cart, including shipping and handling fees and tax.

 

Cancellation of an order by the buyer 

  • Cancellation of an order is subject to the Consumer Protection Law / remote sales transactions (Section 14 C). According to subsection (d)(1) a buyer does not have a right to cancel an order for perishable goods such as food, flowers and drugs. Ex gratia, a buyer that wants to cancel an order for flowers, plants, bouquets and flower arrangements , has to send a cancelation notice by telephone and by email (to: info@balizer.co.il) as soon as possible. In the event that the bouquet or flower arrangement is not yet arranged or is not yet shipped by the time that the notice arrives, the Company will accept the cancelation request. Cancellation of other (non- perishable) product within 14 days from the time of delivery will be accepted provided that the aforesaid notification has been sent, the product is returned to the Company at the point of delivery, the product is not used and is returned in its original packaging.

 

Limits of the warrantee

  • The company is working to ensure that all of its products will be high in quality and worthy of use, and an emphasis is placed on the high quality of flowers, plants, ornamental plants, bouquets and flower arrangements.

  • The company is obliged that the plants, flowers, ornamental plants, floral bouquets, will be of high quality and fresh. In the case that one of the aforementioned products is not fresh (see the aforementioned “damaged products”), the Buyer can reach the company (through the Customer Support Center) to make a report. It is agreed on both sides, that the company will check the complaint and can replace the damaged product, or refund the Buyer in the sum of the purchase price (including shipping fee, only if other services were not placed in the same deal), on the company’s exclusive judgement.

  • The exclusive warrantee for all products that are not flowers, plants, ornamental plants, bouquets and flower arrangements, and any information and presentation presented on the site, with any concern to the product offered on the site, and the essence of the product, including the names of the producer, the quality of the product, pictures of the products and so forth, is on the producer’s, and/or importer’s, and/or distributor’s of the products, governed by the rules and the regulations to protect the buyer and accordingly, on the conditions of the warrantee certificate and the services that are attached to every product or service, where included.

  • The pictures on this site are for illustrative purposes only. It is important to know, that in light of the fact that the pictures are presented on a computer screen, and/or are printed from the computer, there can be differences and changes between the look of the illustrated product to the actual product.

  • In any case, the responsibility of the company, under any legal action on the basis of the products mentioned in this section, will not be more than the actual price of the product/service that has been ordered by the buyer.

  • The company, and/or site owners, and/or site operators, and/or site management, and/or those commissioned on their behalf, are not responsible that the server on which the site is operating, will be free of viruses and malicious elements that could hurt or cause defects to the buyer’s personal computer or any other equipment associated to the buyer whenever he enters or/and orders services and/or uses this site. Furthermore, the company will not be liable for any illegal actions performed on this site by a certain buyer or a third party, which is outside the realm of the company’s control. The company can stop or prevent the connection or the approach of a buyer to any part of the website or to the whole website at any time.

 

Damages and compensation for inappropriate use of the site

  • Anyone that will use the site inappropriately is obliged to pay damages and compensation to the company, and/or to site owners, and/or to site operators, and/or to site management, and/or to those commissioned on their behalf, based on every claim, and/or expense, and/or damages of any kind, including legal fees, caused to the company, and/or to site owners, and/or to site operators, and/or to site management, and/or those commissioned on their behalf.

 

Ownership and reservation of rights

  • The Internet site is supplied with a variety of materials that are protected by copyrights, trademarks (including BaLiZer, the DIY Flower Arrangement pages and procedure), and other intellectual rights. These materials includes images, graphics, music, video, and sound, that are in part owned by the Company and in part which are owned by third parties. Buyer, and/or surfer, and/or any third party participating in actions is not permitted to change, publish, transmit, or transfer, take any part in the transference or selling and using the site, or part of it, in order to create something from it, or to exploit this site, and/or its material, as a whole or in parts for any purpose, not including the purpose that this site was created for. The Company permits the user to download data to a personal computer for personal use, non-commercial in nature. This permit, like every other lawfulaction performed on this site, does not transfer to the user ownership rights on any information that is included in this site.

  • The user agrees not to upload information of any kind to the site that will breach the copyrights, trademarks, and/or any transfer rights and/or pornographic material and/or gossip material and so forth. If the user uploaded information, and/or material as mentioned above, the user agrees to compensate the company, and/or someone on its behalf, and/or the site operator, on the basis of every damage and/or expense (including legal fees and court expenses), that will happen to the company as a result of the misconduct of the user as mentioned above.

  • The site has links to other sites on the Internet. The company supplies these links for the convenience of its users and is not responsible for the information that is appearing on these sites or other sites that are connected to them, including their validity and legitimacy. The buyer that uses these links is doing so, according to their own responsibility.

  • Everyone that wants to link to this site from other sites must make a request in writing and within advanced notice to the company in order to get permission in writing to do so.

 

Other terms and conditions

The Company is permitted to close the site, cancel services, or reduce services. Furthermore, the company will be allowed to change the regulations of the site from time to time.

  • Any disagreement between the buyer, and/or a surfer on the site and the company, on a transaction on the site, will be taken to council in Israel at the courts in Tel Aviv only. The Hebrew version of the Terms and Conditions shall govern.

Appendix AHow to Buy

The purchase process is done by following steps:

  1. Select the interface language (English or Hebrew). You should use the same language as initially has been set.

  2. Select the nearest store to the shipping destination. The site contains several shops in different geographical locations. Each store has its coverage zone. Therefore to obtain the lowest shipping costs you should select the nearest store to the delivery destination.

  3. If you are a registered customer, you should login by providing your e-mail address and password before you start looking for products.

  4. Finding products can be done either by navigating the category bar or by using the "Search by criteria" tool. After locating a product to be purchased, it must be configured (by selection of options such as product size, possible add-ons, and delivery plan). Than place it in your shopping cart.

  5. "One order one destination". Buyer who wishes to purchase multiple products to be delivered to multiple destinations, should make a separate purchase for each destination.

  6. When completing the products' selection, you should go to Checkout.

  7. Before going to Checkout (while in the Shopping Cart page) you should:

• Check the shipping fee (using the Shipping Fee calculator), to ensure that this destination is covered by the store's shipping zone.

• You may redeem your Reward Points to get discount on selected items. Note that only registered customers may gain Reward Points.

  1. In the checkout process you have to provide the Buyer's details, addressee information and the details of means of payment (e.g. credit card) of the buyer. You should provide true information, and give as much details as possible to ensure efficient and quality service.

  2. After the purchase is complete, the shop sends to the buyer's email address an email with the order's details, as well as an electronic invoice and you may get tracking status on the website.

  3. Loyalty Program – under the sole discretion of the website's management, the shop will offer its registered customers to join its Loyalty Program which makes it possible to accumulate Reward Points that can be redeemed for discounts on some of the shop's products. Site Management reserves the exclusive right to decide whether the program will be active, or stop its activity, which products are eligible for discounts, the level of discounts, the conversion rate between Rewards Points and discounts levels, the actions/activities that provide Reward Points, the amount of points per an action and their expiration period.

  4. Abuse of the Loyalty Program – the program allows customers to earn points for activities such as "Product Rating", sending email with "Products Recommendations" etc. These activities enable customers to take advantage and abuse the system by rating products that they did not see or sending mails to fictitious addresses. Such actions constitute an abuse of the Loyalty Program and the website management reserves the exclusive right to approve or disqualify the customers' activities.

  5. If you submit data to us about other individuals (such as your message and gift recipients), you agree that you have obtained consent from each such individual to the submission, transfer and processing of the information.

  6. Phone purchases through the Reservations Center are charged with an extra handling fee which is added to the shopping cart. Site Management reserves the exclusive right to determine the handling fee for phone purchases.
